Teen tried to rape woman

A TEENAGER who tried to rape a woman he heard crying outside his house has been sentenced to serve one year in jail.

Gareth Stirling, 17, was asleep in a house in a Central Australian community when he heard the victim calling out for her husband in the street, and decided to have sex with her in February, 2009.

He went outside, told the woman her husband was inside and followed her into her house. Stirling then pushed the woman into a bedroom, straddled her and took off her clothes as she yelled in an Aboriginal language: "Help me, come on, help me".

She slapped him and kept calling out for help until people started banging on the door. He then got scared and fled the house.

Stirling pleaded guilty in the NT Supreme Court at Alice Springs to one count of attempted rape. Chief Justice Brian Martin said it was fortunate the woman had resisted.

"You attacked a woman who was vulnerable and alone," Justice Martin said. "If she had not put up that resistance and made a noise, you would have succeeded in your efforts and would be here facing a more serious charge of rape."

He sentenced Stirling to two years and nine months in prison, suspended after he serves one year.

Stabbing 'not unreasonable'

August 19, 2010

LINK

IT was not "unreasonable" for a young Acton man to stab his mate who was sleeping with his sister, a court has heard.

Shane Adrian Krause, 23, has pleaded not guilty to assaulting and wounding Samuel Moore on October 13 last year.

The Supreme Court in Hobart heard Mr Krause was deeply offended when he came home and overheard Mr Moore, 22, having sex with his sister.

Mr Krause drove to Mr Moore's Roches Beach house armed with a set of knuckle dusters.

The court heard there was a scuffle, but Mr Moore and Mr Krause gave very different versions of the fight and who came out worse.

Later that day Mr Moore went to Mr Krause's home to confront him.

Mr Krause's lawyer Steve Chopping said his client was by now sorry for the earlier incident and frightened Mr Moore would "kill him".

Mr Krause armed himself with a knife and attempted to drive off in his father's car.

Mr Chopping said Mr Moore grabbed Mr Krause through the car window and it was "not unreasonable", in the circumstances as Mr Krause saw them, for him to drive off and lash out at Mr Moore's arm with the knife.

Witnesses said Mr Moore was dragged along about 60m before he managed to free his arm.

The jury in Mr Krause's trial is about to retire to consider its verdicts.

Self defence tack fails

August 20, 2010

AN overly protective brother who attacked a mate with knuckle dusters because he was sleeping with his sister failed to convince a jury it was self defence.

Shane Adrian Krause, 23, of Acton Park, had argued he acted reasonably when he drove to Samuel Moore's house and punched him with the knuckle dusters.

The Supreme Court in Hobart heard Krause also stabbed Mr Moore in the arm when his victim confronted him about the earlier attack.

His lawyer Steve Chopping argued that was self defence.

A jury took two hours yesterday to find Krause guilty of the crimes.

He was acquitted of a further count of assault related to accusations he intentionally drove off while Mr Moore's arm was stuck in his car window.

The court heard Krause knew about his sister's relationship with Mr Moore, but was deeply offended when he came home and overheard the couple having sex.

On October 13 Krause drove to Mr Moore's Roches Beach house armed with a set of knuckle dusters.

The court heard there was a skirmish, but Mr Moore and Krause gave different versions of the fight and who came out worse.

Later that day, Mr Moore went to Krause's home to confront his former friend.

Mr Chopping said his client was by now sorry for the earlier incident and was frightened Mr Moore would kill him.

Krause armed himself with a knife and attempted to drive off in his father's car.

Mr Moore grabbed Krause through the car window and a terrified Krause drove off, stabbing at Mr Moore's arm with the knife.

Witnesses said Mr Moore was dragged along about 60m before he managed to free his arm.

Mr Chopping said his client, a cannabis-smoking carpenter, was a frightened and paranoid man.

Mr Chopping said Krause had since cut back his drug use.

Justice Peter Evans released Krause on bail and will sentence him next week.

She was leaning in the back door of her car, restraining her child, when a male pushed and hit her.

She fought her way out of the car by kicking and screaming.

Another male has come to the aid, placing the offender in a headlock.

The woman drove off without having time to thank or identify her helper.

Police would like to speak to this man as a matter of priority.

The attacker is described as over 180cm tall, balding, wearing glasses and was wearing a grey/green long-sleeved top.

Anyone who may have witnessed the attack or may have information is urged to contact police on 131 444 or Crime Stoppers on 1800 333 000.

No jail for pregnant attack

August 20, 2010

A PREGNANT mother-of-three was bashed in her front yard by an angry parent, a court has heard.

Lisa Shelton was four months pregnant when Leigh Watson Penneyston attacked her outside her Risdon Vale home on November 18.

Penneyston this morning admitted to the attack, but escaped a jail sentence.

The Supreme Court in Hobart heard Ms Shelton's eight-year-old son had swapped his mobile phone for a BMX and other items belonging to Penneyston's 11-year-old son.

Ms Shelton was angry about the swap and went to Penneyston's partner's house to get her son's phone back.

An angry exchange ensued between the two women and Ms Shelton left, slamming the screen door and taking a toy scooter from the front yard as she went.

A couple of days later Penneyston went to Ms Shelton's house with his stepson and three other males.

She tried to run inside but Penneyston and a younger male started punching her repeatedly to the head and body.

Ms Shelton tried to protect herself and told her attackers she was pregnant.

The men said they did not care and would kill her baby.

Man jailed for fatally stabbing teen with screwdriver

August 20, 2010

LINK

A Sudanese-born Melbourne man who fatally stabbed another countryman with a screwdriver has been jailed for 10 years, with the judge issuing a strong warning that alcohol-fuelled violence will not be tolerated.

Stephen Tito, 22, drank a bottle of bourbon and multiple beers before he struck 19-year-old Afram Kodi after the pair attended a Boxing Day barbecue in Reservoir in 2008.

Tito then stabbed Mr Kodi with the screwdriver three times, the final blow of what Supreme Court Justice Terry Forrest described as an "unprovoked attack" piercing his skull.

Tito, of Reservoir, then kicked Mr Kodi in the chest before pulling the screwdriver out of his head and fleeing the scene.

He was found guilty of Mr Kodi's manslaughter in April.

During sentencing today, Justice Forrest said both men were young members of the Australian Sudanese community who had come to Australia for a better life.

Tito's family had moved here when he was 16 to avoid him becoming a child soldier.

Referring to victim impact statement's from Mr Kodi's family, Justice Forrest told Tito he had "cut short the life of a decent young man".

"By your actions, you have inflicted a blow from which the Kodi family may never recover," he said.

"Your family may never fully recover either."

Justice Forrest noted that Tito was "substantially intoxicated" at the time of the offence.

"It is clear enough that the abuse of alcohol is a problem for you, as it is for so many young Australians," he said.

"Young people in this state are being killed or seriously injured in alcohol-fuelled fighting on an alarmingly regular basis.

"People inclined to participate in these sorts of drunken fights must understand they do so at their peril and that the courts will not tolerate that type of conduct."

He ordered Tito to serve six years and three months before being eligible for parole.

Men jailed over tourist's bashing death

August 20, 2010

Two men have been jailed over the death of 25-year-old Canadian man Cain Aguiar following a fight outside Yarraville's Blarney Stone pub last year.

Fostar Akoteu, 23, was this morning sentenced to 10 years' jail with a minimum of seven years' after he pleaded guilty earlier this month to manslaughter.

His friend, Sioeli Seau, 20, received an 18-month jail sentence with a minimum of 12 months after he pleaded guilty to common assault.

He is eligible to apply for parole now having already served 401 days awaiting sentence.

Another man will go to trial early next year over the incident, which the court heard was witnessed by several people.

Mr Aguiar died five days after a fight with the pair following a night out on July 9, 2009.

Justice Simon Whelan told Victoria's Supreme Court that a drunk Akoteu got jealous of a female friend spending time with Mr Aguiar at the hotel.

He said Akoteu had admitted during his police interview that Mr Agiuar did nothing to provoke the fight outside the pub after it closed.

Akoteu told several people, including Seau, that he planned to assault Mr Agiuar, Justice Whelan said.

Seau indicated he would support him, stating "don't worry about it ... I'll fight with him", before he approached Mr Aguiar and swung a punch.

Akoteu joined the fray as a security guard and another person tried to separate Mr Aguiar, who took off his jacket and took actions to defend himself.

"But he did not, at any stage, represent a threat to you or your friends," the judge said.

He added that while Seau had "instigated" the assault, Akoteu was the "principal aggressor". Another member of the group allegedly punched Mr Aguiar with considerable force, which caused him to hit his head on the ground.

"In the course of his fall his head struck the pavement with sufficient force to cause a sound which was heard by a number of bystanders," he said.

"Whilst he was lying unconscious, or at least helpless, with his head in the gutter, you either stomped on his head or kicked him in the head.

"As you stomped or kicked the head of this defenceless person, who had done nothing to provoke you and who represented no threat to you, you taunted him."

Akoteu agreed that he had said to Mr Aguiar: "Welcome to Australia, bitch".

"Mr Aguiar sustained serious injuries as a result of this attack," he said.

"He had a fractured cheekbone and a fracture which extended from the right temporal bone around the right base of the skull. He also had lacerations on his head and some other bruising."

His condition deteriorated later and on July 14, Mr Aguiar's parents, Issy and Tony, having arrived from Canada, made the decision to withdraw treatment. He died at 8.50pm that night.

Justice Whelan described the circumstances as the attack as "shocking" before he cited excerpts of Mrs Aguiar's victim impact statement.

It read: "Thirteen months have gone by and the shock and disbelief are as raw today as it was the day our son died. We have been irrevocably changed with our sense of the world now warped. Although we intellectually know the truth, our hearts often refuse to accept Cain is never coming back. We loved him and always will, and not a day goes by that we don't think of our son and remember all that he was to us".

He said both men, who have each fathered two children, had a history of drug and alcohol abuse.

He took into consideration their guilty pleas, remorse and good prospects of rehabilitation when sentencing.

Man charged over co-worker stabbing

18 Aug, 2010

LINK

A dispute between co-workers at a Dickson restaurant ended with one man suffering wounds to his face and near the base of his skull.

Hongfeng Ma, 34, was remanded in custody after appearing in the ACT Magistrates Court charged with two offences related to the attack.

A police statement of facts tendered to court said Ma attacked co-worker Qiang Zhou in the kitchen area of the Dickson Dumpling House about 9.30pm on Monday as staff were preparing to close.

Ma was armed with a meat cleaver and Swiss pocket knife attached to a key-chain.

Appearing in court yesterday, Ma was dressed in police issue coveralls and was kept abreast of proceedings through a Cantonese interpreter.

The statement of facts says Qian Zhou received a stab wound to the ''base of his skull near the top of the spinal cord and a deep laceration from the left corner of his mouth to [the] base of his cheekbone''.

A co-worker intervened and wrestled Ma to the ground with the help of a second person. The police statement said Ma would not release his grip on the meat cleaver or pocket knife.

The statement said a waiter kicked the meat cleaver out of Ma's hand before using a piece of broken wood to pry the pocket knife from his grasp.

The statement said two men at the nearby Sub-Urban restaurant witnessed the incident and called 000.

When police attended they found Ma with blood on his hands, face and clothing.

In an interview early yesterday, Ma told police through an interpreter he ''had been thinking about what he was going to do and opened the knife about 20 minutes before he began to stab Mr Zhou''. He said he believed Mr Zhou would harm him if he did not act first and stated ''I feel anxiety''.

Ma's counsel made no application for bail and said his client would undergo a psychiatric assessment. He was remanded in custody to appear on August 30

No jail for vicious attack on strangers

19 Aug, 2010

A Canberra man has avoided jail time for his part in a vicious attack on two men who were crossing Northbourne Avenue ''minding their own business''.

Patrick Gillies, 24, told the ACT Supreme Court through his lawyer that he thought his mother was in danger when he set upon the pair shortly after 6pm on June 28 last year.

According to a statement of facts, the victims were crossing the road when they heard someone call out expletives, and turned to find Gillies, his mother, Lisa Chatfield, and another woman, Maria McIntosh, following them.

Gillies caught up to the men on the median strip and repeatedly punched one of them, then tackled the second, who suffered blows from one of the women before freeing himself and calling police.

The trio then attacked the first man, kicking him in the head as he lay on the ground.

They went across the road and returned with a shovel that Gillies used to beat the man, yelling, ''I am going to kill you, c---.''

One of the women repeated the assault, then, when the man tried to get to his feet, Gillies whacked him between the shoulders.

Police later arrested the assailants and the man was taken to Canberra Hospital with facial injuries, a scalp wound and broken teeth.

Yesterday, the court heard Gillies, who pleaded guilty to assault occasioning actual bodily harm, was drunk at the time of the offence and had mental health problems.

Justice Richard Refshauge said sentencing Gillies for his part in the ''vicious, brutal, prolonged and apparently unprovoked'' attack in Braddon was difficult, partly because he had no previous convictions.

Gilles did not give evidence and provided no explanation for the violent assault, other than that he felt his mother was in danger and he would ''do anything to protect [her]''.

But Justice Refshauge said there was nothing in the statement of facts that indicated Gillies had a reason to attack ''two men apparently minding their own business''.

A pre-sentence report said Gillies had dropped out of school because he felt he was being racially vilified, and had never held a job.

He started drinking heavily in his early 20s, when his mental health problems increased, but said he had not drunk since the incident save for at Christmas.

Justice Refshauge gave Gillies a nine-month prison sentence, fully suspended on him signing a two-year good-behaviour order and 50 hours of community service. The court heard Chatfield was sentenced to six months of weekend jail for her part in the attack and that McIntosh was given an eight month suspended sentence with a two-year good-behaviour order, and that both women had significant criminal histories.

Gold Coast brother Jade and Dionne Lacey face sentencing for torture, deprivation of liberty and extortion

August 19, 2010

LINK

THE gun used by Gold Coast brothers Jade and Dionne Lacey to kill a Nerang gardener was used in a separate shooting, a court was told today.

The pair are due to be sentenced today in the Brisbane District Court for torture, deprivation of liberty and extortion.

The Lacey brothers were convicted in March of abducting teenager Owen Colin Matthews at gunpoint and forcing the 19-year-old to dig his own grave on a deserted island.

They shot Matthews in the hand using a gun which they later used several weeks later to kill landscape gardener Kevin Palmer, 23.

Judge Tony Rafter had initially adjourned sentencing of the pair while they awaited the outcome of a special leave application in the High Court in June relating to their sentences for the unlawful killing of Nerang landscape gardener Kevin Palmer.

The two brothers remain in court sitting alongside each other both dressed in a suit and tie.

Dionne, 23, is already serving an 11-year jail term for the manslaughter of Palmer.

Jade, 27, was jailed for five years for unlawfully wounding Palmer.

Michael Byrne SC has argued that their sentences should be tacked on to their jail terms already being served.

"What occurred to Owen Matthews was horrific,'' he said.

"He had a game of Russian Roulette played on him.

"These two (Jade and Dionne) have shown no remorse.''

Dione's defence lawyer Ian Temby, OC, said his client did something "foolish and seriously wrong'' but there was still hope for him.

"There is good in this young man although in respect of these offences he has gone off the rails,'' he told the court.

Mr Temby has argued it would be a "crushing burden" on his client to give him a long sentence.

The sentencing is continuing.

Weapons linked with the desire to feel safe

August 16, 2010

UP TO three-quarters of teenagers who live in Melbourne's west believe gangs are a presence in their neighbourhoods and a third have had an encounter with them, according to a two-year study on community safety.

Researchers surveyed 500 people aged 15 to 19 in the Brimbank council area to compile the findings released today in The Age. The participants were drawn from 20 western suburbs including Sunshine, St Albans, Deer Park, Keilor and Taylors Lakes.

The conduct they identified with gangs ranged from anti-social behaviour in public places - commonly youths being loud and ''eyeballing'' others - to more intimidating fights and bashings.

The study, commissioned by Victoria Police and conducted independently by Victoria University, also found half the survey participants said they knew of other young people who carried weapons ''regularly''.

Dislodged supermarket trolley poles, bats, knives, machetes and sometimes guns were identified as weapons chosen by their peers. The participants said the desire to carry such weapons was linked primarily to the need to feel safe, protected or for self-defence.

About a quarter of those surveyed also acknowledged that they had carried weapons at some time, saying they did it primarily to ensure their personal safety. Males were twice as likely to have engaged in such activity.

Overall, only half the participants said they felt safe or extremely safe in their neighbourhoods. Train and bus stations were seen as among the least safe places to gather.

''There is a widespread perception among young people that there are street gangs in their area, yet the vast majority of group gathering in public places is not being done by young people whom we'd associate as being in 'gangs','' said Michelle Grossman, an author of the study.

A striking feature of the ethnically diverse urban landscape of Melbourne's west, Professor Grossman said, was the propensity of its younger residents to ''hang out'' in public - with 76 per cent of survey participants saying they often or sometimes engaged in this type of outing.

''Overwhelmingly, what we found was that young people tend to gather in cross-ethnic groups based on friendships, common interests and in order to feel safe in the local area. One of the common assumptions these young people reject is that youth congregate in ethnically based gangs with criminal intent.''

The study, which encouraged the youth to speak freely and guaranteed confidentiality, also sought participants' views of police. While 58 per cent said they felt safer when they saw officers on the street, just under half acknowledged young people in their area held negative views of police.

Furthermore, only half the participants said they trusted or completely trusted police.

Asked how police could develop better relationships with them, the youth emphasised better communication and conduct towards young people by street police.

''These findings are an indication to police that they could do more to work with young people to improve trust,'' co-author Jenny Sharples said.

A Perth teenager who armed himself with a 32cm knife and stormed into a school classroom in June had wanted to stab a girl he fancied.

The 15-year-old student, who yesterday pleaded guilty in Perth Children's Court to threatening the classmate with a knife in a northern suburbs high school, was attracted to the girl but barely knew her.

Prosecutor Clare Stanyer told the court: "He stated (to the police) that he intended to stab the victim and then stab himself."

The case bears striking similarities to the stabbing murder in 1991 of Vicky Groves at Churchlands Senior High School.

The boy also pleaded guilty to one count of being armed or pretending to be armed in a way that would cause fear.

The conviction follows that on Friday of an Esperance schoolboy, also aged 15, who brought a loaded double-barrel shotgun to school last Thursday. His lawyer said he "snapped" after repeated bullying.

The court was told yesterday that on June 21, the Perth teenager took a knife - which had a 19cm blade - to school and brandished it about before chasing a group of children into the classroom.

When in the classroom the boy singled out the girl and thrust the knife at her.

She grabbed a chair and used it to defend herself until a teacher arrived at the classroom and disarmed the boy.

At the time of the incident it was reported that the teacher had to hit the boy's wrist to force him to drop the knife.

_The West Australian _ understands that other staff members then grabbed the knife and the boy was taken to the principal's office, where he remained until police arrived. He was taken to Princess Margaret Hospital for an assessment.

The teenager's lawyer, John Collier, said his client did not know the girl very well and that there was no relationship between the two.

Mr Collier said: "He states that he had some sort of attraction for her."

The court was told that the teenager had no criminal record and that his actions were an aberration.

Mr Collier said the boy was no longer attending the school and that his family had since sought psychiatric help for him.

The teenager will be sentenced on September 7 by Children's Court Magistrate Andree Horrigan after psychiatric and psychological reports have been completed.

At the time of the incident an Education Department spokesman said the boy had been suspended and students involved in the incident were offered counselling.

He was remanded into the custody of his parents with a condition that he not approach the girl.

On Friday, the Esperance teenager pleaded guilty in Kalgoorlie Children's Court to being armed in public so as to cause fear, possession of a firearm without being a holder of a firearm licence and unlicensed possession of ammunition. He will be sentenced on September 17.

Police have charged a 34-year-old male with assault occasioning actual bodily harm in relation the attack on activist Simon Margan - the co-convenor of Community Action on Homophobia - and three other men.

The attack left Mr Margan bleeding on the ground with a severely fractured left eye-socket.Police will allege it was one of four separate assaults by the same man at different locations along the famous party strip.

Mr Margan was treated at St Vincent's Hospital along with another of the alleged victims who suffered bruising and swelling to his left eye.

"I was walking up Oxford Street toward Crown Street when a flying kick just missed my head," Mr Margan said.

"I thought he might have a knife, so I stepped back to call for help. When I turned away to call down the street he kicked me again - hitting me in the eye."

Mr Margan said the same man had made violent homophobic comments toward him a few days earlier as he put up posters promoting a gay rights rally taking place a Sydney Town Hall today.

"Every time I turned around he was there ranting about eradicating gays on Oxford St. It was more full-on than you usually get, so when I saw him on Monday night I was really scared he was going to do something extreme."

The 34-year-old make was denied bail to appear in Central local court on Monday, where police will allege that he was affected by alcohol. They also will present video footage from CCTV cameras on Oxford Street as evidence.

A police media spokesman said that there was "no indication that the men's sexuality was involved[as a motive] in the attack", but Mr Margan said he was in no doubt about his attacker's motive.

He said gay hate crimes were not uncommon on Oxford Street, but were only occasionally reported.

"People seem to think, 'I've been assaulted, I'll just get on with my life'," he said.

"We need people to call these attacks what they are - hate crimes. If people don't report them, then they're not setting an example for the next time it happens and the next time."

The Town Hall rally is part of a nation-wide action calling for marriage equality.
