A FORMER child soldier from Sudan was jailed yesterday for raping a woman who mistook him for a friendly neighbour.
Kondok Mario-Ring, 29, of West Moonah, told police the sex was consensual but in fact his victim was a lesbian who had not had sex with a man for 20 years.
The Supreme Court in Hobart heard the 45-year-old woman was moving into a new flat when Mario-Ring struck up a conversation over the fence.
When she went inside to make them both coffee, Mario-Ring forced himself upon her.
His first trial ended with a hung jury but he was found guilty of rape in a re-trial.
The court heard Mario-Ring's victim was traumatised by the attack and has needed ongoing counselling and suffers frequent nightmares.
"She has attempted to take her own life and suffers panic attacks when she sees a black male," Justice Shan Tennent said.
Mario-Ring came to Hobart in 1998 as a refugee from Sudan after enduring the violence of a civil conflict.
Justice Shan Tennent said cultural clashes had impeded Mario-Ring's ability to gain work in Tasmania and he was on a disability pension.
"This has resulted in a tendency to drink to excess," Justice Tennent said.
Mario-Ring's record included convictions in Tasmania for wounding, assaulting a police officer and assault.
He can apply for parole after serving 2 1/2 years.
